Litigation: Environmentalists seek stay of revised EPA oil & gas NSPS

Nearly a dozen environmental groups are urging the U.S. Court of Appeals for the District of Columbia Circuit to stay portions of EPA’s “reconsideration rule” that weakened or eliminated leak detection and other requirements for new oil and gas facilities under the Obama-era new source performance standards (NSPS). The request in a Nov. 13 motion in Environmental Defense Fund, et al. v. Andrew Wheeler comes after the court in separate litigation declined to stay the agency’s related NSPS “policy rule”...
